The Rules in Oregon
Oregon repealed auctioneer licensing decades ago, but it did not deregulate conduct. ORS 698.635 through 698.650 impose baseline duties on anyone auctioning consigned property: pay the consignor within 21 calendar days, keep proceeds in a separate trust account, and name the auctioneer in advertisements. Violating these rules is an unlawful trade practice under Oregon's UTPA, which carries real enforcement teeth.
A written agreement is not required as a baseline — but you need one if you want to vary the statutory defaults, such as the payment date or the handling of unsold property. There is no bond or recovery fund. Local permits may apply depending on your city, so verify locally.
