Auctioneer License Requirements in New York

Local/municipal rules only. New York has no statewide auctioneer license, and even New York City repealed its auctioneer licensing in 2022 — only conduct and record-keeping rules remain at the state level.

What Online Auctioneers Need to Know

There is no state license for an online-only auction to be exempt from. NYC's licensing was repealed by Local Law 80 of 2021 (effective June 15, 2022); whether other localities license auctioneers is unverified, so check your municipality.

The Rules in New York

New York does not license auctioneers statewide, and its most famous local regime is gone: New York City repealed auctioneer licensing effective June 15, 2022. What remains at the state level is General Business Law article 3 (sections 21 through 28), which imposes conduct and record-keeping rules on auctions rather than a license.

GBL section 25 requires consignment record-keeping but does not mandate a written contract, and there is no statewide bond, escrow rule, or settlement deadline. If you operate outside NYC, verify whether your locality has its own auctioneer ordinance.
