Maine has a real online exemption: under 32 M.R.S. § 286(8), you are exempt if you take goods under contract "for the exclusive purpose of selling them over the Internet." A pure online consignment operation can qualify; anything with a live component does not.

Maine licenses auctioneers through the Board of Licensing of Auctioneers within the Office of Professional and Occupational Regulation, under 32 M.R.S. chapter 5-B. The notable feature for online sellers is the section 286(8) exemption: taking goods under contract exclusively to sell them over the internet falls outside the licensing requirement. Confirm your model fits the exemption's exact terms before relying on it.

For licensed auctions, section 298 is one of the more detailed contract statutes in the country: the written contract must include the date, the auctioneer's name and license number, descriptions of the items, whether there is a reserve, the payment schedule, the commission, and any buyer's premium. Maine has no statutory settlement deadline, trust-account rule, or bond.
