Auctioneer License Requirements in Arkansas
State license required. Arkansas requires a state auctioneer license, and since Act 677 of 2023 that expressly includes online auctions and estate sales.
What Online Auctioneers Need to Know
There is no online exemption — the opposite. Act 677, effective August 1, 2023, extended Arkansas licensing to online auctions (and estate sales), so an internet-only operation needs the license just like a live one.
The Rules in Arkansas
Arkansas licenses auctioneers through the Arkansas Auctioneer's Licensing Board under title 17, chapter 17 of the Arkansas Code. The regime was deliberately expanded in 2023 to reach online auctions, so the medium you sell through does not change whether you need the license.
Once licensed, two rules shape how you handle consignors. Section 17-17-308 makes operating without a written contract a disciplinable offense, with the contract's required contents spelled out in Board rules. Board rules also require an escrow account for auction proceeds and settlement with consignors within 10 business days. No surety bond appears to be required — verify with the Board.
